FACTS FOUND (1). The boats were approaching the top mark in gentle winds in a light chop. (2). AUS222 was approaching the top mark on starboard slightly below closed hauled and held his course to leave the mark one and a half boat lengths to leeward. (3) THA 1488 on port entered to zone clear ahead of NED1. (4) THA1488 tacked to starboard to round the mark but did not achieve close hauled and went into irons for several seconds one boat length from the mark, as observed by a member of the Jury. (5) NED1 tacked promptly onto starboard and established an inside overlap on THA1488 then promptly bore away onto a reach to the offset mark. (6) THA1488 briefly luffed up slightly and collided with AUS222. (7) There was damage to the port side of AUS222. (8) THA1488 got clear of other boats and immediately took one penalty turn.

CONCLUSIONS AND RULES THAT APPLY RRS 61.1(c) - NED1 was originally a witness but the Jury decided to make her a party to the Hearing. RRS13 - THA1488 was on starboard but was still tacking when she hit AUS222. RRS14 - THA1488 could have avoided hitting AUS222 if her tack had been completed promptly. RRS64.1(b) - THA1488 took a penalty turn and so exonerated herself. SI13.1 changes RRS44.1 to one penalty turn. Other Rules - RRS14 AUS222 could not have reasonably expected THA1488 to luff up unexpectedly. RRS 16.1 - AUS222 held her course throughout the incident. RRS18.1(a) - When THA1488 tacked to starboard and NED1 was still on port it turned off RRS18.2. RRS15 - THA1488 gave NED1 room to keep clear as NED1 tacked on starboard inside THA1488. RRS18.2(a) Applied between THA1488 and NED1 after NED1 tacked to starboard inside THA1488. RRS18.2(e) Did not apply between THA1488 and NED1 as there was just enough room between THA1488 and the mark to allow NED1 room to round the mark.

FACTS FOUND (1) The Texel rating created for the two person Nacra F16 with spinnaker is 104 and not 101 as claimed by AUS290. The spreadsheet with the calculations were provided to AUS290.

FACTS FOUND (1) Andy Wells GBR310 fell off his boat north of Koh Krok in Race number three today. 2) He was rescued by NED2646. 3) He was dropped off again near his boat 200 metres away. 4) It took 5 minutes for NED2646 to do this rescue.

FACTS FOUND 1) Wind was 8 to 9 knots. 2) Tide was on the ebb and so likely to take boats over the line. 3) Ten seconds before the start GBR7834 tried to luff up NED1198 above the race committee boat but could not do so as NED 1198 had a small overlap with the RC boat. 4) Four seconds before the start GBR7834 was over the line. 5) NED1198 was slightly to windward of and on the stern quarter of GBR7834. 5) NED1198 was over the line two seconds before the start signal. 6) Two boats were seen to be over the line by the Jury boat at the pin end but the sail numbers were too far away to read. 7) Shortly after the start signal the RC promptly displayed the X flag and made one sound signal. 8) The sound signal was heard by NED1198.

FACTS FOUND 1) NED1198's protest was invalid as he did not hail protest, but as there was serious damage the Jury opened a protest hearing against NED1198 and NED7924. 2) Both boats were reaching along the start line for 50 metres. 3) NED7924 hailed up several times. 4) With fifteen seconds before the starting signal NED1198 bore down on and collided with NED7924. 5) NED1198 suffered a 15 by 15 cm gash in her port bow. 6) NED7924 hailed protest. 7) NED1198 did a penalty turn. 8) NED1198 realised she was sinking and returned to shore for repairs.

CONCLUSIONS AND RULES THAT APPLY 1) RRS 60.3a(1) - There was serious damage so the Jury initiated a Hearing. 2) RRS 11 - NED1198 did not keep clear of NED7924. 3) RRS 14 - NED1198 could have reasonably avoided contact and had room to keep clear. 4) RRS14 - NED7924 could not have reasonably avoided contact with NED1198. 5) RRS 64.1(b) NED1198 took a penalty turn and exonerated herself.
